Intro to TRE® Tension and Trauma Release Workshop - Terms and Conditions

PLEASE READ THIS AGREEMENT CAREFULLY. THIS IS A BINDING CONTRACT BETWEEN YOU AND PRIMAL ALCHEMY METHOD, LLC.

These are the terms and conditions on which Primal Alchemy Method, LLC (hereafter known as “We”, "our", "us", or “Primal Alchemy Method”) agrees to allow you, the Participant, to participate in yoga classes, somatic coaching sessions, TRE® instruction, trauma support activities, workshops, courses, and other programs, events and activities conducted or organized by or through Primal Alchemy Method, whether presented in person, at a physical location, online, live, recorded or otherwise (each one an “Activity” and collectively, with all related activities, the “Activities”). 

Please read these Terms and Conditions carefully as they apply to all Activities offered by Primal Alchemy Method and your participation in any Activities indicates your acceptance and agreement to all of these Terms and Conditions. Please note that additional terms and conditions govern the use and sale of products and services on our website. 

By proceeding to participate in any Activities, you’re indicating to Primal Alchemy Method that you’ve read, understood and agreed to enter into a binding agreement with us on these terms and conditions. If you have any questions or concerns about our Activities, this Agreement or the Website, or any purchase you make through the website, please don’t hesitate to get in touch with us.

By participating in any Activities, and as a condition for the opportunity to do so, the Participant acknowledges and agrees as follows.

1. Assumption of Risk

All exercise, fitness, somatic sessions, and trauma support activities involve some inherent risks of physical and/or mental and/or emotional injury, damage, disability or, under rare circumstances, death. Even meditation and mindfulness activities may not be entirely risk-free for some individuals. Consultation with a physician or other appropriate health-care professional is highly recommended before commencing any form of exercise, fitness, somatic session, trauma support, meditation and mindfulness activities. If Participant makes a decision to participate in an Activity, the Participant is responsible for seeking and obtaining medical clearance to do so. If Participant is pregnant or becomes pregnant or is post-natal, Participant will not participate in any Activities without first discussing the risks with their doctor, and Participant will only participate in an Activity if they have their doctor’s full approval. If Participant decides to participate in this Activity, whether with or without medical clearance, the Participant is doing so at his or her own risk, including risks of physical and/or emotional and/or mental injury, damage, disability, or death. 

Participant understands that Primal Alchemy Method and its Instructors are not physicians, psychologists or other medical professionals, and the Activities being offered are not to be construed as medical advice and should not be a substitute for any medical treatment or mental health treatment. Participant additionally understands that this Activity is not intended to treat or diagnose any illness, disease, or disorder, whether physical, mental, psychological or emotional.

2. Age of Participant 

Participant is 18 years of age or older and an adult of legal age in the state of his or her residence. If the Participant is a minor who seeks to participate in an Activity intended for children or adolescents, then the parent or guardian of the Participant (“Parent/Guardian”), acting on behalf of himself or herself and the Participant, ratifies and approves this Release and agrees that both Participant and Parent/Guardian will be bound by all terms and conditions of this Release.

3. Consent to Use of Information

If you choose to share information about yourself and your experiences during your participation in any Activity, whether in person and/or online, you are thereby waiving your privacy rights as to any disclosures you may make.

4. Release of Primal Alchemy Method

The Participant acknowledges and agrees that Primal Alchemy Method, LLC (“Primal Alchemy Method”), is not responsible or liable in any manner whatsoever for any act or omission of any of the instructors who conduct Activities (each one an “Instructor” and, collectively, “Instructors”), and/or any of Instructor’s employees, contractors, lessors, vendors, agents or other related parties, and/or any third parties who may participate as supervisors, sponsors, observers, and/or in any other capacity (“Third-Party Participants”), whether in connection with this Activity and/or any equipment or materials used in connection with this Activity.

5. General Release and Waiver of Claims

In consideration of the Participant being permitted to participate in the Activity, and to the fullest extent permitted by law, the Participant, by signing this Release and by his or her participation in the Activity, voluntarily releases, waives, discharges and gives up, in advance of any participation in the Activity, any claims and causes of action of any and all kind whatsoever that Participant may be entitled to assert against Primal Alchemy Method, Instructors, and Third-Party Participants, and any of their respective shareholders, members, directors, officers, employees, contractors, lessors, vendors, agents or other related parties, other participants in the Activity and all others, as applicable, and releases all of the foregoing persons from any and all liability for injury, death, damage or loss suffered by Participant while participating in the Activity, using the venue or other facilities where the Activity is offered, engaging in any activities incidental thereto, including traveling to or from any location of said activities wherever, whenever, or however the same may occur, which result from the ordinary negligence of those released in this Release.

6. Intellectual Property Rights

Primal Alchemy Method authorizes you to view and use the content of the Activity (“Content”) solely for your personal, noncommercial use. The Content is protected by copyright under both United States and foreign laws. Under no circumstances will your access to, or use of the Content result in you or any other user obtaining any right, title or interest in the Content, or any portion thereof. Unauthorized use of the Content may violate copyright, trademark, and other laws. Except as expressly provided otherwise, no portion of the Content may be reverse- engineered, disassembled, decompiled, reproduced, transcribed, in a retrieval system, translated into any language or computer language, retransmitted in any form or by any means (electronic, mechanical, photo reproduction, recordation or otherwise), resold or redistributed without the prior written consent of Primal Alchemy Method, which may be withheld in Primal Alchemy Method’s sole and absolute discretion. Primal Alchemy Method reserves all rights under copyright, trademark, and other applicable law to the Content.

7. Payment

By placing an order or paying for a class, workshop, somatic coaching session, course or training on the Site, you authorize Primal Alchemy to charge the card utilized as the payment method to obtain the relevant funds. You represent and warrant that you have the legal right to use the payment method utilized in connection with any such order or other transactions. You agree that any purchase charge may occur several business days after your transaction(s) has occurred and after the date shown on your transaction receipt(s).

Unless otherwise noted on the Site or in the Materials, all purchased class series shall expire six (6) months from activation. All sales are final for products that are delivered digitally including but not limited to ebooks, PDF guides, audio meditations and breathing bundles (excludes 1:1 and Group Coaching Refund Policies – See individual contracts for refund policies). Gift cards and gift certificates may only be redeemed for Primal Alchemy merchandise or services and are non-refundable and non-transferable. Gift cards and gift certificates cannot be redeemed for cash.

8. Refunds and Cancellations

Refunds may be granted up to seven days before the start date of any in-person workshop. Cancellations less than seven days from the start of the workshop will result in the loss of any fees paid.

9. General Provisions.

The Participant’s intent is to give full legal validity to this Release and to bind the Participant, the Parent/Guardian if applicable, and their respective heirs, executors, administrators, successors and assigns. If any part of this Release is deemed to be invalid, this Release shall remain in full force and effect on its remaining terms and conditions. If the Participant or anyone else ever attempts to disaffirm or void this Release, the Participant agrees to indemnify and hold all of those released in Section 4 above absolutely harmless from any and all such attempts, claims, suits or causes of action, judgments and all costs or expenses of those released hereby, including all reasonable attorneys’ fees. 

It is agreed that only the laws of the State of Hawaii and the United States of America shall apply to this Agreement and that it is to be given full and complete effect to the fullest extent provided by law. 

Definitions

Agreement means this Agreement between Primal Alchemy Method, LLC and the Participant, which commences as set out in this document.

Participant means the person or entity entering into this Agreement with Primal Alchemy Method, LLC by agreeing to these terms and participating in any Activities. The Participant may also be referred to as “you” throughout this Agreement.

Intellectual Property Rights means all intellectual property rights of any kind, in any jurisdiction, subsisting now or in the future (including, without limitation, business, company or trade names, domain names, patents, inventions, copyright, design rights, know-how, trademarks, the right to sue for passing off and rights to use, and protect the confidentiality of, Confidential Information), whether registered or unregistered, and including the rights to apply for or renew the registration of any such rights and any rights the subject of any lapsed application or registration, as well as all digital and electronic rights.

Activities means any yoga class, somatic coaching session, TRE® instruction, trauma support activities, workshops, courses, and other programs, events, and activities conducted or organized by or through Primal Alchemy Method, LLC, whether presented in person, at a physical location, online, live, or recorded.

We refers to the legal entity carrying on business known as “Primal Alchemy Method, LLC,” which includes the sale of access to this Workshop on the Website at the time of commencement of this Agreement, or such other entity as validly assumes that entity’s rights and obligations under this Agreement in accordance with the terms of this Agreement. We may also be referred to as “us”, “our”, or “Primal Alchemy Method” throughout this agreement.

Website means the website located at https://www.lizarch.com, https://primalalchemymethod.com, and https://www.primalyoga.com, or such as other URL where we make the Activity available for sale from time to time.
